Short answer
AI cold calling means one of two things: an AI voice agent that dials prospects and holds the conversation itself, or AI that helps human reps cold call faster with answer detection, voicemail drops, call summaries and practice. The first kind is the legal problem. The FCC ruled in February 2024 that AI-generated voices are "artificial" voices under the TCPA, so an AI calling a cell phone or home line needs the person's prior express consent, and prior express written consent for a sales call. A cold list has neither.
The second kind is where AI earns its keep on a cold-calling floor. I've run sales floors for years, and the split is simple: let AI voices call people who asked to hear from you, and let AI make your reps better at calling everyone else.
Not legal advice. This is our plain-English reading of the public rules as of October 23, 2026, with links to the source text. Rules change and states differ. Talk to a TCPA lawyer before you launch any AI calling program.
| AI cold calling at a glance | AI voice agent places the call | AI helps human reps call |
|---|---|---|
| Who talks to the prospect | The AI | Your rep |
| Federal consent rule | Prior express written consent for sales calls to cells and home lines | Same rules as your dialer |
| Typical price | About $0.07 to $0.31 a minute | Quote only, per seat |
| Best for | Consented leads, callbacks, reactivation | True cold calling |
What is AI cold calling?
AI cold calling is the use of artificial intelligence on outbound sales calls to people who haven't talked to you yet, either by letting an AI voice agent run the call or by giving human reps AI tools while they dial. Vendors lump them together, but the law and the results differ.
AI cold calling agent: the AI makes the call
An AI cold calling agent is a voice agent that dials, talks and books the meeting with no person on the line. It runs on a phone line, speech-to-text, an AI model and a voice, tied together by an agent layer (how an AI voice agent works).
AI dialer: the AI helps your reps call
An AI dialer keeps a human on every live conversation and uses AI around it: detecting whether a person or voicemail picked up, dropping a voicemail, summarizing the call and scoring it. Orum and Nooks are the best-known examples; the other dialer types are in our sales dialer guide.
Is AI cold calling legal?
AI cold calling with an AI voice is legal only when the person called has given consent, which a true cold list never has. The FCC's Declaratory Ruling FCC 24-17, released February 8, 2024, says callers "must obtain prior express consent from the called party before making a call that utilizes artificial or prerecorded voice simulated or generated through AI technology."
Three lines in that ruling matter for sales teams:
- Sales calls need written consent. If the AI call advertises or contains telemarketing, the FCC's rules require prior express written consent, not just consent.
- No live-agent loophole. The TCPA "does not allow for any carve out of technologies that purport to provide the equivalent of a live agent." An AI that holds a real conversation is still an artificial voice.
- The call has to identify you. Every artificial-voice message must name the business at the start, give a callback number, and on sales calls offer an automated opt-out by voice or key press (47 CFR 64.1200(b)).
A 2024 FCC proposal would also make AI calls say they're AI at the start (FCC 24-84); we found no final rule as of October 23, 2026.
| Line you're calling | AI voice sales call, federal rule |
|---|---|
| Cell phone (personal or business) | Prior express written consent |
| Home landline | Prior express written consent |
| Business landline | Not named in the TCPA's artificial-voice consent rule; state laws and your carrier's terms can still apply, so get counsel's sign-off first |
What TCPA consent do AI calls need?
AI sales calls need prior express written consent: a signed agreement, electronic signatures included, that clearly authorizes the seller to call that number with an artificial or prerecorded voice, and that says signing isn't a condition of buying. Nobody on a bought list has signed that. Each violation carries $500 in statutory damages, up to three times that if willful (47 U.S.C. 227). Do Not Call lists and calling hours still apply; our TCPA rules for sales calls cover them.
Does the TCPA apply to B2B AI calls?
The TCPA's artificial-voice rule has no business-to-business exemption: it covers any number assigned to a cellular service, so a business owner's cell phone gets the same protection as anyone's. The FTC's Telemarketing Sales Rule does exempt most business-to-business calls (16 CFR 310.6), but that exemption doesn't touch the TCPA.
Is AI cold calling illegal in some states?
California's rule is aimed squarely at AI. Since January 1, 2025, a California call made with an automatic dialing-announcing device has to open with a live person who states the business, asks whether the person consents to hear the recorded message, and says if it "uses an artificial voice" (Cal. Pub. Util. Code 2874). Those calls are also banned between 9 p.m. and 9 a.m., with an exception for people you already have a relationship with or who asked for the call (2872).
Utah requires a business using generative AI with consumers to say it's AI when the person clearly asks (SB 226, 2025). Florida requires written consent for sales calls that use an automated system or a recorded message, with its own lawsuits at $500 per violation (501.059). More states keep adding rules.
Does AI cold calling work?
AI cold calling works when the AI is calling warm, consented leads or helping a human rep, and it fails when an AI voice is pointed at a cold list. The cold list is the problem before the AI is: only 19% of Americans usually answer a cell call from an unknown number, and 67% let it go to voicemail and check the message later (Pew Research, 2020).
High-volume calling burns lists fast. When we ran predictive and parallel dialing, a fairly small team went through about 30,000 leads a month. The answering machine detection left a pause after people said hello, and that pause killed trust immediately. Our numbers got flagged as spam, which burned even more leads. An AI voice dialing thousands of cold numbers a day repeats that at a bigger scale, with a consent problem on top.
Where AI does work on outbound:
- Speed to lead. An AI agent calling a web lead within a minute of the form fill, with consent captured on the form.
- Reactivation of past customers who agreed to calls.
- The rep's side of a cold call: answer detection, voicemail drops, notes written for the rep, and scoring that shows a manager which calls to coach.
AI cold calling software
AI cold calling software splits into AI cold caller platforms that run the call, AI dialers that help reps, and AI practice tools that train reps before they dial. Every price below is from the vendor's own pricing page, checked October 23, 2026.
AI cold caller platforms
AI cold caller platforms bill by the minute: Bland AI charges $0.12 to $0.14 a minute, Retell AI $0.07 to $0.31 all in, and Vapi $0.05 a minute in hosting plus the AI parts. None of them takes on your consent obligations.
| Platform | Price | Outbound notes |
|---|---|---|
| Bland AI | $0.14/min on the $0 Start plan; $0.12/min on Build at $299/mo | 100 calls a day on Start, 2,000 on Build |
| Retell AI | $0.07 to $0.31/min, 20 concurrent calls included | Branded caller ID +$0.10 per call |
| Vapi | $0.05/min hosting plus model, voice and phone costs | $82 to $129 per 1,000 minutes on Vapi's own estimate |
| Synthflow | Enterprise from $30,000 a year | Per-minute rates not published |
The most telling line in this market comes from a vendor. Bland, which sells plans of up to 2,000 outbound calls a day, explains on its own site why using it "for AI outbound calling, particularly for cold calling, is not permissible under current U.S. regulations" and points customers to inbound and receptionist work instead.

Be wary of "replace your SDRs" pitches, too. The FTC sued Air AI in 2025 over deceptive earnings and refund claims, and the 2026 settlement bans it from marketing business opportunities (FTC).
AI dialer for sales teams
An AI dialer for sales teams keeps reps on the phone and lets AI skip the dead air, one of the five jobs AI does in an AI call center. Orum includes AI answer detection, parallel and power dialing, voicemail drops, AI call summaries and AI objection detection in its base plan, quote only with a nine-seat minimum. Nooks offers AI answer detection, multi-line dialing, number rotation with reputation monitoring, transcription and AI call scoring, also quote only. Parallel dialing still has to respect the two-second abandoned-call rule, and a voicemail drop is a prerecorded message.
Cold calling practice AI
Cold calling practice AI lets reps rehearse against an AI buyer and scores the run, with no consent issue because nobody outside your team gets called. Hyperbound has a free tier with 45 prebuilt roleplays and quote-only paid plans; Orum and Nooks sell roleplay as part of their coaching tools.
How much does AI cold calling cost?
AI cold calling costs about $70 to $420 for 1,000 minutes of AI voice calls a month on the published per-minute platforms, before you count phone numbers, and AI dialers for human reps are priced per seat by quote. The per-minute fee is the part to watch: it never stops, and it sits on top of the raw phone line and AI model costs underneath.
Retell's price list shows the stack: $0.055 a minute for its voice engine, $0.015 for a standard voice, $0.015 for US telephony, then the AI model. Vapi passes models through at cost and adds $0.05 a minute in hosting. Our Retell AI pricing and Bland AI pricing guides break each bill down line by line.
When AI sales calls make sense (and when they burn your list)
AI sales calls make sense when the person asked to hear from you, the script is narrow, and a human takes over when the call gets interesting. They burn your list when an AI voice dials cold numbers at volume.
| Use AI voice for | Keep humans on |
|---|---|
| Calling new web leads in the first minute | Cold lists and bought data |
| Confirming and rebooking appointments | Price and objection-heavy calls |
| Reactivating past customers with consent | Anything a closer needs to read |
| After-hours inbound, as an AI receptionist | Calls into states with live-intro rules |
Whatever runs the calls, the calling system needs guardrails. In the dialers we build, calling-hour limits are applied in each customer's local time, by state, with holiday and Sunday rules and per-state daily call limits where they apply. Numbers on your do-not-call list are blocked when a list is uploaded and again before every dial, and reps can mark a number do-not-call during a call. These are tools that help you follow the rules. They are not legal advice, and you're still responsible for your own compliance.
Build your own AI voice agent
Build your own AI voice agent when AI calls are a steady part of your business and the per-minute platform fee has become a real line on the bill. Every AI agent rents a phone carrier and an AI model; what you can own is everything above that layer: the conversation logic, scripts, CRM and calendar hookups, recordings and transcripts.
An owned agent runs on your hosting, with the phone line and AI minutes billed as utilities at cost, no platform markup, and either vendor swappable. Renting is the better call at low volume or for a simple after-hours line. The same logic took one client's four stitched-together sales tools from about $4,500 a month to about $300 in hosting (case study).
What it costs: typically less than you spend today, paid monthly, and the build payments have an end date. Here's how pricing works. The SaaS cost calculator adds up your current stack in about two minutes, and if it comes out at a few thousand a month, book a free audit.

Frequently asked questions
Is AI cold calling legal?
Only with consent. The FCC ruled in February 2024 that AI-generated voices are artificial voices under the TCPA, so an AI voice calling a cell phone or home line needs the person's prior express consent, and prior express written consent if it's a sales call. A cold list has neither. AI that only helps a human rep dial is regulated like any other dialer. This isn't legal advice.
Is AI cold calling illegal for B2B calls?
The TCPA's artificial-voice rule has no business exemption, so an AI voice calling a business owner's cell phone needs the same consent as any other cell phone call. The FTC's business-to-business exemption doesn't change the TCPA, and states such as California have their own rules for automated calls. Ask a TCPA lawyer before relying on any exemption.
Does AI cold calling work?
AI voice agents work on people who asked to hear from you: web leads, missed callbacks and reactivation calls with consent on file. On cold lists they mostly burn leads and phone numbers. The AI that reliably helps cold calling sits on the rep's side: answer detection, voicemail drops, call summaries, scoring and practice.
What is the best AI cold calling software?
For AI voice agents calling people who opted in, Retell AI and Vapi publish per-minute prices and Bland AI sells volume plans, though Bland says its platform can't be used for cold calling. For AI that helps human reps, Orum and Nooks are the main AI dialers, both quote-only. Pick by the job: agents for consented follow-up, AI dialers for true cold calling.
Can an AI cold calling bot leave voicemails?
It can, but an AI or prerecorded voicemail is an artificial or prerecorded voice message under the TCPA, so it needs the same consent as a live AI call when it goes to a cell phone or home line. A rep's own recorded voicemail drop counts as prerecorded too.
